Since July 2000, APARI which I supervise has been running a drug training program for defendants on bail. In Japan, it is reported there are 2.2 million stimulant abusers with approximately 30,000 of those prosecuted every year as drug criminals. Re-offence rates are especially high amongst stimulant users, estimated at 50%, but no measures have been taken to prevent reoccurrence.

This program is for those prosecuted and on bail for drug crimes, incorporating volunteer work and participation in self-help groups, enabling offenders to return to a drug free life. Most personal use first time offenders receive suspended sentences with no treatment to stop them reoffending. However, it is not compulsory for drug offenders to attend specialized drug organization courses, therefore, many recommit drug crimes while serving suspended sentences, or are imprisoned, become more dependent, or are in and out of mental hospitals as a result. Some people use further drugs while on bail. Being arrested and prosecuted provides an ideal opportunity for the defendant to reform and change their lives.

Article 93, 3rd Clause of the criminal procedure code attaches the conditions which restricts a defendant dwelling address and other appropriate conditions, so dependents can get treatment to prevent reoffending if they attend APARIs institution ( we had a real case of this nature ). If bail is granted under the condition of attending training at APARI, you can regain a regular lifestyle, learn about drug addiction, participate in meetings daily with other drug addicts within the rehabilitation institute. This time can be spent as an opportunity to learn a new set of values for future life.
