Why is the Program Required ?
Drugs crimes cannot be solved by punishment alone. There is a limit to what the police can do.
It is said that drug measures in Japan are 20 years behind those in the West. Japans shortage of social resources targeting individual drug abuse is the lowest in Asia. Japans emphasis appears to be on controlling crime initially, rather than aftercare, recovery and social rehabilitation. Severe punishment for drug offenses does not act as a deterrent alone and should reflect a realistic approach to treatment rather than just long prison sentences. On the other hand in Western countries they consider heavy punishment ineffective and have given priority to remedies rather than punishment. From looking at the past Western countries have realized even if they tighten legal measures, the black market continues to grow.
50 Percent Re-offend.
In most cases, personal use first time offenders get suspended sentences, which means many of them return to their drug use environments without any treatment to stop them offending again. The re-offence rate is approximately 50 percent. However we cant make it compulsory for drug offenders to attend specialized drug organization programs after receiving suspended sentences. Therefore many addicts re-offend while serving their suspended sentences and are imprisoned or become more dependent and often are in and out of mental hospitals as a result. Also some actually use more drugs than usual while on bail.
The difficulties of interfering in the early stages of drug addiction.
It is very difficult to intervene in the early stages of drug abuse, everybody thinks they can stop drugs easily at first. Drug addicts don't contact rehabilitation centers for help until they have lost their health, jobs or family. Even though being arrested and prosecuted are good opportunities for stopping their drug abuse, there are no treatments available to them.
The time on Bail is the Single Chance.
APARI started a drug rehabilitation program for people arrested and prosecuted for drug crimes while on bail. Article 93, 3rd Clause of the Criminal Procedure Code attaches the conditions which restrict a defendants dwelling address and other appropriate conditions, so defendants can get treatment to prevent re-offending if they attend APARIs institution. With approximately 30,000 drug offenders per year, this time on bail is the single chance to receive drug rehabilitation and prevent reoccurrence.
